Overview

Avoota builds technology and services that help people discover, compare, and book comfortable hotel stays across India and the world. These Terms of Service (the "Terms") govern your access and use of the Avoota platform — including our website, mobile apps, features, and all related services (collectively, "Avoota Products" or "Products").

By using our Products, you agree to these Terms, which form a binding agreement between you and Avoota Travel Technologies Pvt. Ltd. If you do not agree, please do not access or use Avoota or any of its services.

Avoota does not charge you for browsing. Accommodation providers, hotels, and partners pay us to list and promote their properties on our platform. We use your preferences and data to show you relevant listings and personalised offers.

We do not sell your personal data to third parties. Our Privacy Policy explains how we collect, process, and protect your information.

These Terms (formerly the Avoota User Agreement) constitute the entire agreement between you and Avoota Travel Technologies Pvt. Ltd. and supersede any prior agreements.

1 The Services We Provide

Avoota's mission is to help every traveller discover comfortable, quality accommodation at the best value. Our platform connects travellers with hotels, resorts, homestays, and serviced apartments through an easy-to-use search and booking experience.

1.1 What Avoota Offers

  • Hotel search & discovery — Browse thousands of properties filtered by location, price, star rating, amenities, and guest reviews.
  • Real-time availability & pricing — Live rates fetched directly from hotels and our supply partners (including TBO and other GDS/OTA connections).
  • Secure booking — Confirm reservations instantly with immediate confirmation emails and booking vouchers.
  • Manage my trips — View, modify, or cancel upcoming bookings from your Avoota account dashboard.
  • Reviews & ratings — Read verified guest reviews and share your own stay experience.
  • Customer support — 24/7 assistance via chat, email, and phone for booking queries and emergencies.

1.2 Third-Party Providers

Avoota acts as an intermediary/agent facilitating bookings between you and accommodation providers. The actual hotel service is provided by the property, and Avoota is not responsible for the quality, safety, or accuracy of services delivered by those providers beyond what is displayed on our platform.

ℹ️ Avoota reserves the right to modify, suspend, or discontinue any feature of the platform at any time with reasonable notice.

2 How Our Services Are Funded

Avoota is a free-to-use platform for travellers. We generate revenue primarily through:

  • Commission fees — Hotels and accommodation providers pay Avoota a commission for each confirmed booking made through our platform.
  • Sponsored listings — Hotels may pay to appear prominently in search results or on our homepage. Sponsored properties are clearly labelled.
  • Advertising — We display relevant travel-related advertisements (flights, travel insurance, car rentals) to help fund free services for users.
  • Service & convenience fees — In some cases, a small platform service fee may be charged at checkout, which will always be disclosed before payment.

Our revenue model does not influence the integrity of reviews or ratings, which are based solely on verified guest feedback.

3 Your Commitments to Avoota and Our Community

3.1 Account Eligibility

To use Avoota, you must be at least 18 years of age and capable of forming a legally binding contract. By creating an account, you confirm that you meet these requirements.

3.2 Accurate Information

You agree to provide accurate, current, and complete information when registering and making bookings. Providing false information (such as fake names, fraudulent payment details, or incorrect guest counts) may result in immediate cancellation of your booking and suspension of your account.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@avoota.com if you suspect unauthorised access to your account.

3.4 Prohibited Activities

You agree not to:

  • Scrape, crawl, or harvest data from Avoota's platform without written permission.
  • Use the platform to make fraudulent or speculative bookings.
  • Post false, misleading, or defamatory reviews or content.
  • Circumvent, disable, or interfere with security features of the platform.
  • Use automated tools, bots, or scripts to access or interact with Avoota services.
  • Engage in any activity that violates applicable Indian or international laws.

4 Bookings & Payments

4.1 Making a Booking

When you complete a booking on Avoota, you enter into a contract directly with the accommodation provider. Avoota facilitates this transaction as an authorised agent. Your booking is confirmed only upon receipt of a confirmation email with a Booking Reference Number (BRN).

4.2 Pricing

All prices displayed are in Indian Rupees (INR) unless stated otherwise, and include applicable taxes. Prices are dynamic and may change at any time until your booking is confirmed. Avoota is not liable for pricing errors caused by third-party data feeds; however, we will notify you and offer a full refund in such cases.

4.3 Payment Methods

We accept UPI, credit/debit cards (Visa, Mastercard, RuPay), net banking, and select digital wallets. All transactions are processed through PCI-DSS compliant payment gateways. Avoota does not store your full card details on its servers.

4.4 Special Requests

Special requests (early check-in, late check-out, room preferences) are communicated to the hotel but cannot be guaranteed. Fulfilment is at the hotel's discretion.

5 Cancellations & Refunds

5.1 Cancellation Policy

Each hotel listing specifies its own cancellation policy (free cancellation, partially refundable, or non-refundable). The applicable policy is displayed prominently before you complete your booking. You are bound by the policy applicable at the time of booking.

5.2 Refund Processing

Approved refunds are processed within 7–14 business days and credited to the original payment method. Processing time may vary depending on your bank. Avoota's platform fee (if any) is non-refundable unless the cancellation is caused by an Avoota error.

5.3 No-Shows

If you fail to check in on the scheduled arrival date without prior cancellation, the full booking amount may be forfeited as per the hotel's no-show policy.

5.4 Force Majeure

In cases of natural disasters, government-mandated travel restrictions, or other force majeure events, Avoota will work with accommodation providers to offer flexible rebooking or credit notes, subject to availability.

6 User-Generated Content

By submitting reviews, ratings, photos, or other content ("User Content") on Avoota, you grant Avoota a non-exclusive, royalty-free, worldwide, perpetual licence to use, display, reproduce, and distribute that content in connection with our services.

You represent that your User Content is original, does not infringe any third-party rights, and is not defamatory, offensive, or misleading. Avoota reserves the right to remove any content that violates these guidelines or our community standards.

Reviews must reflect genuine first-hand experiences. Fake, incentivised, or malicious reviews are strictly prohibited and may result in account suspension.

7 Intellectual Property

All content on Avoota — including the logo, brand name, website design, software, databases, text, photographs, graphics, and interface elements — is the exclusive property of Avoota Travel Technologies Pvt. Ltd. or its licensors and is protected under applicable intellectual property laws.

You may not copy, reproduce, republish, upload, post, transmit, or distribute any Avoota content without our prior written consent. Unauthorised use may result in legal action.

8 Limitation of Liability

To the maximum extent permitted by applicable law, Avoota shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profit, data, goodwill, or business interruption arising from:

  • Any act or omission by a hotel or accommodation provider.
  • Inaccurate property descriptions or photos provided by hotels.
  • Technical outages, platform errors, or data inaccuracies beyond our reasonable control.
  • Your use of or inability to use our platform.

Avoota's total aggregate liability to you for any claim arising out of these Terms shall not exceed the total amount paid by you to Avoota in the twelve (12) months preceding the claim.

9 Dispute Resolution

In the event of a dispute between you and Avoota, we encourage you to first contact our Customer Support team at support@avoota.com to seek an amicable resolution.

If the dispute cannot be resolved informally within 30 days, it shall be subject to binding arbitration under the Arbitration and Conciliation Act, 1996, with proceedings conducted in Tirupati, Andhra Pradesh, India. The language of arbitration shall be English.

These Terms are governed by the laws of India. Both parties submit to the exclusive jurisdiction of the courts in Tirupati, Andhra Pradesh for matters not subject to arbitration.

10 Additional Provisions

10.1 Changes to Terms

Avoota may update these Terms from time to time. We will notify you of material changes via email or prominent notice on our platform at least 30 days before they take effect. Continued use of our services after the effective date constitutes your acceptance of the revised Terms.

10.2 Termination

You may close your Avoota account at any time by contacting support. Avoota reserves the right to suspend or terminate your account without notice if you violate these Terms, engage in fraudulent activity, or cause harm to the platform or community.

10.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

10.4 Entire Agreement

These Terms, together with our Privacy Policy and any supplemental policies, constitute the entire agreement between you and Avoota regarding your use of our Products.
